Body
WHEREAS, after a trial by jury, the Circuit Court of Jackson County on May 26, 1995, entered a ju gment in the case of Jackson County v. Faulkner, No. CV91-32652, the consolidated condemnation act on for the remaining parcels in the View High Drive Projects, Nos. 2194 and 2195, in the total amo nt of $319,500.00; and,
WHEREAS, the County had previously paid into court the sum of $156,000.00, pursuant to the Commiss oners' Award for these parcels; and,
WHEREAS, the County now owes the difference between these two figures, $163,500.00, plus interest n the amount of $15,009.30, for a total due and owing by the County of $178,509.30; and,
WHEREAS, an appropriation from the unappropriated surplus of the 1995 Special Road and Bridge Fund is necessary to satisfy this judgment; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropria ion be made from the unappropriated surplus of the 1995 Special Road and Bridge Fund:
DEPARTMENT/DIVISION CHARACTER/DESCRIPTION FROM TO Unappropriated Surplus $178,510
Division of Administration Public Works Department Engineering View High Drive Other Improvements $178,510 and,
BE IT FURTHER ORDAINED that the Manager of the Division of Finance be and hereby is authorized to ssue checks in the total amount of $178,509.30, pursuant to the specific instructions of the Count Counselor.
Attorney Effective Date: This ordinance shall be effective immediately upon its signature by the County Ex cutive.
