Body
WHEREAS, the Director of Parks and Recreation recommends that the construction of docks on Prairie Lee Lake be regulated by the County; and,
WHEREAS, such regulation is in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:
Section A. Enacting Clause. Sections 5037., Jackson County Code, is hereby enacted to read as follows:
5037. Construction of Docks on Prairie Lee Lake, Permit Required.
An owner of lakeside property at Prairie Lee Lake, directly abutting the lake, may be permitted to construct a dock on the lake in accordance with this section. Each such dock shall be compatible with other docks and lakeside residences in terms of size, type, spacing between docks, and method of construction. No person shall erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any dock or similar structure on the waters of Prairie Lee Lake, or cause or permit the same to be done, without first obtaining a valid permit from the director of public works.
5037.1 No Fee for Lakeside Property Owners.
No fee for a permit under this section shall be assessed against an owner of lakeside property at Prairie Lee Lake.
5037.2 Standards.
The issuance of a permit under this section shall be governed, to the extent practicable, by the standards of chapter 54 of this Code, the Uniform Building Code, and the policy enunciated in this section.
Section B. Penalty Provision. A violation of this Ordinance is punishable pursuant to § 5093., Jackson County Code, 1984.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its passage by the County Executive.
