AN ORDINANCE appropriating $450,000.00 from the unappropriated surplus of the 1999 Criminal Justice Fund to cover costs associated with the litigation of claims arising out of the Jackson County Detention Center Annex project.

Body
WHEREAS, an appropriation is necessary to cover costs associated with the litigation of claims arising out of the Jackson County Detention Center Annex project; and,
WHEREAS, the County Counselor has agreed to provide the County Legislature in closed session, weekly or as frequently as the Legislature desires, the following: updates on the progress of the litigation, updates on expenditures from this appropriation, copies of all agreements entered into on behalf of the county paid for out of this appropriation and copies of all billings statements or invoices received and/or paid out of the funds appropriated hereby; and,
WHEREAS, the County Counselor has agreed the funds appropriated hereby shall be spent only on litigation of claims arising out of or associated with the construction or renovation of the Detention Center; and,
WHEREAS, the County Executive recommends this appropriation as an amendment to her recommended 1999 Jackson County budget; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the unappropriated surplus of the 1999 Criminal Justice Improvement Fund be and hereby is made:

BE IT FURTHER ORDAINED that any funds appropriated by this Ordinance which remain unencumbered or unspent at the end of the 1999 budget year, unless transferred as authorized by the county code, shall revert to the unappropriated surplus of the criminal justice improvement fund...Attorney
Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
