BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  A conditional use permit is hereby approved for a period of  twenty (20) years to operate a mobile home park on a certain tract of land described as follows:

Description: A 12 ± acre tract of land approximately ½ mile south of Truman Road on the west side of Stark Avenue and specifically described as:

 

Beginning at the SE corner of Lot 18, THE CROWN, a subdivision of land in the E ½ of the NE 1/4 of Section 7, Twp.  49, Rng. 32, said point being on the West right-of-way line of Stark Ave. 25 ft. from the center line thereof and 660 ft. ± South of the North line of said 1/4 section; thence along said West right of way line parallel to and 25 ft. West of the East line of said 1/4 section South 1 degree 43 minutes 19 seconds West 575.55 ft. thence continuing along the West right-of-way line of Stark Ave. South 1 degree 43 minutes 19 seconds West 397.31 ft.; thence South 55 degrees 36 minutes West 95.67 ft.; thence North 2 degrees 06 minutes East 448.48 ft.; thence South 87 degrees 41 minutes 10 seconds West 64.22 ft.; thence South 43 degrees 04 minutes 11 seconds West 746.41 ft.; thence South 1 degree 41 minutes 21 seconds West 35 ft.; thence along the Easterly line of tract recently acquired by the Jackson Co. West of the SE corner of Lot 91, THE CROWN; thence South 87 degrees 07 minutes 34 seconds East 174.74 ft. to the SW corner of Lot 55; thence Northerly 70 ft. to the NW corner of Lot 56; thence South 87 degrees 07 minutes 34 seconds East 222 ft. to the NE corner of Lot 53; thence Southerly 70 ft. to the SE corner of Lot 54; thence South 87 degrees 07 minutes 34 seconds East 151 ft. to the SE corner of Lot 19; thence Northerly 70 ft. to the NE corner of Lot 17; thence South 87 degrees 07 minutes 34 seconds East 111 ft. to the NE corner of Lot 17; thence Southerly along the West line of Stark Avenue 70 ft. to the point of beginning, containing 12.08 acres.

 

 

Section 2.  The conditional use permit granted by this ordinance is subject to the following conditions:                     

 

1)                     That the area designated as Lots 1 through 15 on the rezoning plat be properly maintained and used for a park area and open space.

2)                      That the above park area be posted with designated play area signs.

3)                      That no more than 58 mobile homes are allowed within this mobile home park.

 

Section 3.  The Legislature, pursuant to the application of Blue Ridge Mobile Home Park (CU-2002-165), requesting approval embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on September 19, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
