Body
WHEREAS, the Tarsney Lakes Citizens Association, Inc., a Missouri Non-Profit Corporation has requested an easement from the County to facilitate the construction and maintenance of a water line to a fire hydrant on the following described tract of land:
Part of Lot 7, Block 26, Tarsney Lakes, a subdivision in Jackson County, Missouri, described as follows:
A strip of land 25.00 feet in width lying 12.50 feet on each side of the following described centerline. Commencing at the northwest corner lot 2, Block 23 of said subdivision thence North 10 degrees, 11 minutes West, 119.40 feet to a point on the east line of said Lot 7, Block 26, said point also being the true point of beginning of the centerline of said 25.00 foot wide strip of land; thence North 77 degrees, 56 minutes West, 75.00 feet to a point of termination. (The North line of said Lot 2, Block 23 is assumed to bear North 89 degrees West).
and,
WHEREAS, the aforementioned easement, is necessary in order to run the water line to a fire hydrant and there is no practical way to avoid the use of County road right-of-way; and,
WHEREAS, for this easement, the Tarsney Lakes Citizens Association, Inc., a Missouri Non-Profit Corporation has agreed to pay the sum of $10.00 and other valuable consideration; and,
WHEREAS, the granting of this easement is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute a permanent water easement in favor of the Tarsney Lakes Citizens Association, Inc., a Missouri Non-Profit Corporation, in a form substantially similar to that attached, as approved by the County Counselor.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
