BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 86 ± acre tract of land approximately ½ mile east of Gammon Road, 1/4 of a mile north of Stringtown Road, north of the present termination of Whippoorwill Lane and specifically described as:
PART OF THE EAST HALF OF SECTION 28, TOWNSHIP 47, RANGE 30, JACKSON COUNTY, MISSOURI, DESCRIBED AS BEGINNING AT THE NORTHEAST CORNER OF WHIPPOORWILL PLACE - FIRST PLAT, A SUBDIVISION OF LAND IN JACKSON COUNTY, MISSOURI AS PREVIOUSLY PLATTED AND RECORDED, SAID POINT ALSO BEING ON THE EAST LINE OF SECTION 28, TOWNSHIP 47, RANGE 30 THENCE SOUTH 89̊54'40" WEST ALONG THE NORTH LINE OF SAID WHIPPOORWILL PLACE - FIRST PLAT, SAID POINT BEING ON THE EAST LINE OF HEDGECOCK ACRES, A SUBDIVISION OF LAND IN JACKSON COUNTY, MISSOURI AS PREVIOUSLY PLATTED AND RECORDED; THENCE NORTH 02̊21'28" EAST ALONG THE EAST LINE OF SAID HEDGECOCK ACRES, 1507.93 FEET TO THE SOUTHWEST CORNER OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 47, RANGE 30; THENCE NORTH 02̊19'33" EAST, 1321.43 FEET; THENCE NORTH 89̊51'31" EAST, 1323.01 FEET TO THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER SECTION 28, TOWNSHIP 47, RANGE 30; THENCE SOUTH 02̊13'32" WEST ALONG THE EAST LINE OF SECTION 28, TOWNSHIP 47, RANGE 30, 1321.80 FEET TO THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER SECTION 28, TOWNSHIP 47, RANGE 30; THENCE SOUTH 02̊17'26" WEST ALONG THE EAST LINE OF THE SOUTHEAST QUARTER SECTION 28, TOWNSHIP 47, RANGE 30; 15 20.78 FEET TO THE TRUE POINT OF BEGINNING. CONTAINING 86.20 ACRES, MORE OR LESS, SUBJECT TO ANY EXISTING EASEMENTS.
Section 2. The preliminary plat "Whippoorwill Place - 2nd Plat," creating a fifteen-lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of Carswell, LLC (RZ-2004-329), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on January 15, 2004, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
