AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 157.5 ± acre tract and approving the preliminary plat "Windsor 5th Phase," creating a twenty-lot residential subdivision.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:  A 157.5 ± acres generally located south of Windsor 3rd and 4th Phases, west of Highland View subdivision on Howard Road and Milton Thompson Road, north of Wildflower subdivision on Langsford Road and east of the City of Lee's Summit Legacy Park and specifically described as:

 

TRACT OF LAND BEING ALL OF THE EAST HALF OF THE SOUTHEAST QUARTER OF SECTION 35 AND ALL OF THE SOUTHWEST QUARTER OF SECTION 36 LYING NORTH OF MILTON THOMPSON ROAD AND WEST OF HIGHLAND VILLAGE, A SUBDIVISION IN JACKSON COUNTY, MISSOURI, EXCEPT THE FOLLOWING DESCRIBED TRACT: BEGINNING AT THE SOUTHWESTERLY CORNER OF LOT 17, SAID HIGHLAND VILLAGE; THENCE NORTHWESTERLY, ALONG THE WESTERLY LINE OF SAID LOT, 280 FEET; THENCE SOUTHWESTERLY, PARALLEL WITH THE NORTHERLY RIGHT-OF-WAY LINE OF MILTON THOMPSON ROAD, 241 FEET, MORE OR LESS, TO THE EAST LINE OF THE WEST HALF OF THE SOUTHWEST QUARTER  OF SAID SECTION 36; THENCE NORTH, ALONG SAID LINE, 114.00 FEET; THENCE WEST, AT RIGHT ANGLES TO SAID LINE, 150.00 FEET; THENCE SOUTH, PARALLEL WITH SAID LINE, 517 FEET, MORE OR LESS, TO THE NORTHERLY RIGHT-OF-WAY LINE OF SAID MILTON THOMPSON ROAD, THENCE NORTHEASTERLY, ALONG SAID LINE, 40.00 FEET FROM THE CENTERLINE THEREOF, 567FEET, MORE OR LESS, TO THE POINT OF BEGINNING, ALL BEING IN TOWNSHIP 48, RANGE 31, JACKSON COUNTY, MISSOURI.

 

Section 2.  The preliminary plat "Windsor 5th Phase," creating a twenty-lot residential subdivision, is hereby approved.

 

Section 3. The Legislature, pursuant to the application of George Ward (RZ-2003-321), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 5 to 1 to recommend this application in a public hearing on October 16, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

                                                               

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
