IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI
Title
AN ORDINANCE appropriating $15,415,000 from the undesignated fund balance of various funds and authorizing the County Executive to execute Cooperative Agreements to fund infrastructure projects with certain municipalities within Jackson County in an amount not to exceed $15,415,000.

Body
WHEREAS, the American Rescue Plan Act (ARPA) of 2021, enacted by the U.S. Congress, provided financial support to local governments responding to the public health and economic impacts of the COVID-19 pandemic; and,
WHEREAS, Jackson County received a total allocation of $136,551,645.00 in ARPA funds; and,
WHEREAS, ARPA funds were obligated by December 31, 2024, and will be fully expended by December 31, 2026, with strict adherence to federal requirements for eligibility; and,
WHEREAS, on December 18, 2024 the Jackson County Legislature adopted Ordinance 5955, obligating those funds and ordained that fifty percent (50%) of the future funds recouped from ARPA revenues would be exclusively obligated to Jackson County infrastructure needs; and,
WHEREAS, while traditionally this process has referred to these funds as “ARPA funds” the funds allocated with this resolution come directly from various County revenue and are not ARPA funds; and,
WHEREAS, should any receiving agency or municipality fail to timely provide all requested documentation and/or fail to comply with state law or County Code related to the distribution, they shall be subject to return of funds to be reallocated to other agencies or municipalities; and,
WHEREAS, an appropriation is necessary to place the funds in the proper spending account; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the appropriations from the included fiscal note from various funds be and hereby are made, and;
BE IT FURTHER ORDAINED that the Finance Department is hereby authorized to make any transfers necessary to give effect to the intent of this Ordinance; and,
BE IT FURTHER ORDAINED, that the Legislature hereby authorizes the County Executive to award funding to the following projects and/or municipalities:
