BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The preliminary plat "Elm Grove - 6th Plat," creating a 46-lot residential subdivision, is hereby approved as to a 11.8 ± acre tract more specifically described as follows:

Description: 

 

The 11.8 ± acres is legally described as: A tract of land located in the South ½ of Section 20, Township 50N, Range 31W, Jackson County, Missouri more particularly described as follows:

 

Beginning at the SE corner of "Elm Grove 5 th Plat", a subdivision located in said South ½; thence along the Easterly line of said subdivision the following five (5) courses: 1.) N 02̊25'33" E, a distance o313.49 feet, 2.) N 09̊28'29" E, a distance of 46.49 feet, 3.) N 26̊32'23" E, a distance of 127.09 feet, 4.) N 19̊41'20" E, a distance of 83,75 feet, 5.) N 07̊58'00" E, a distance of 90.55 feet to the NE corner of said subdivision; thence S 82̊02'00" E, a distance of 725.44 feet; thence S 02̊24'00" W, a distance of 655.88 feet to a point on the Northerly right of way line of "Lexington Road", as it now exists; thence N 81̊56'42" W along said right of way line, a distance of 817.51 feet to the POINT OF BEGINNING, containing 11.83 acres, more or less, all being subject to easements, restrictions, and rights of way.

 

Section 2.   The Legislature, pursuant to the application of Vern Thompson requesting the action described in this Ordinance and with notice that the Jackson County Plan Commission voted unanimously to recommend approval of this application at a public hearing on February 16, 2006, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
