BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: The 7 ± acres are approximately ½ mile south of Steinhauser Road on the west side of Outer Belt Road (Mo. Route H) and specifically described:
THAT PART OF THE SOUTHWEST QUARTER AND THE SOUTHEAST QUARTER, ALL IN THE SECTION 5, TOWNSHIP 49 NORTH, RANGE 29 EAST, JACKSON COUNTY, MISSOURI BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF THE SOUTHWEST QUARTER OF SECTION 5, TOWNSHIP 49 NORTH, RANGE 29 EAST, JACKSON COUNTY, MISSOURI; THENCE SOUTH 01 DEGREES 20 MINUTES 28 SECONDS WEST ALONG THE EAST LINE OF SAID QUARTER, A DISTANCE OF 300.09 FEET; THENCE EAST ALONG A LINE PARALLEL TO THE NORTH LINE OF SAID SOUTHWEST QUARTER A DISTANCE OF 71.30 FEET TO A POINT ON THE WESTERLY RIGHT OF WAY LINE OF MISSOURI ROUTE "H" AND SAID POINT BEING THE POINT OF BEGINNING; THENCE SOUTH 19 DEGREES, 11 MINUTES, 57 SECONDS EAST ALONG THE WESTERLY RIGHT OF WAY LINE, A DISTANCE OF 465.64 FEET; THENCE NORTH 87 DEGREES 15 MINUTES 46 SECONDS WEST ALONG A LINE PARALLEL TO THE NORTH LINE OF SAID SOUTHWEST QUARTER, A DISTANCE OF 794.55 FEET; THENCE NORTH 02 DEGREES 44 MINUTES 14 SECONDS EAST, A DISTANCE OF 431.93 FEET; THENCE SOUTH 87 DEGREES15 MINUTES 46 SECONDS EAST ALONG A LINE PARALLEL TO THE NORTH LINE OF SAID SOUTHWEST QUARTER, A DISTANCE OF 620.60 FEET, TO THE POINT OF BEGINNING, CONTAINING 7.016 ACRES, MORE OR LESS, SUBJECT TO EASEMENTS, RIGHT OF WAY AND RESERVATIONS OF RECORD.
Section 2. The Legislature, pursuant to the application of Gordon Garlett (RZ-2003-326), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted unanimously to recommend this application in a public hearing on November 20, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
