Body

WHEREAS, a regional  9-1-1 system provides emergency telephone service for Jackson, Clay, Platte, Ray, and Cass Counties in Missouri, and Johnson, Leavenworth, and Wyandotte Counties in Kansas (hereinafter referred to as "the Counties"); and,

 

WHEREAS, for over 18 years the Counties have worked cooperatively with one another and with public safety agencies and telephone companies to plan and implement this 9-1-1 system; and,

 

WHEREAS, K.S.A. 12-5301 and RSMo. 190.300 authorize Kansas and Missouri counties to levy surcharges on telephone service to finance the 9-1-1 system and to make appropriate expenditures for its implementation; and,

 

WHEREAS,  the Mid-America Regional Council (hereinafter referred to as "MARC") has coordinated the planning and implementation of the regional E 9-1-1 system since its inception; and,

 

WHEREAS, pursuant to Ordinance 2418, dated June 5, 1995, Jackson County joined  the Counties and MARC in a "9-1-1 Interlocal Cooperative Agreement," which provided for the lease of certain enhanced answer point equipment, established detailed plans for sharing costs among the Counties, and established a process for installation, training, and ongoing oversight of the system; and,

 

WHEREAS, the Counties and MARC now desire to enter into Addendum No. 1 to the Interlocal Cooperation Agreement, a copy of which is attached hereto, to provide for the further upgrading and continued operation of the regional E 9-1-1 system; and,

 

WHEREAS, under this Addendum, Jackson County will be responsible for its pro rata share of the $7,907,272.00 cost of the upgrade, and other costs of operating the system, for a period of five years, with payments commencing in calendar year 2002; and,

 

WHEREAS, this Addendum is in the best interests of the health, welfare, and safety of the citizens of Jackson County; therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Addendum No. 1 to the Interlocal Cooperation Agreement and any and all other documents necessary to effect the upgrade and improvement of the regional E 9-1-1 emergency telephone system; and,

BE IT FURTHER ORDAINED that the Manager of the Division of Finance be and is hereby authorized to make all payments including final payment of the Agreement, to the extent that sufficient appropriations are included in the then current county budget.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
