Body
WHEREAS, the Legislature did, by Resolution 18174, dated May 20, 2103, award a contract to Superior Bowen Asphalt Company, LLC, of Kansas City (Jackson County), MO, in the actual amount of $481,377.52 for the 2013 Pavement Maintenance Project Phase 1 (asphaltic concrete overlay, chip seal, and pavement marking), No. 3169; and,
WHEREAS, a portion of Cook Road located in unincorporated Jackson County is in need of repairs and citizens residing the area have voiced concerns about its condition to representatives of the Public Works Department; and,
WHEREAS, the bids for the annual Pavement Maintenance Project came in under the budgeted amount and the contractor has agreed to honor the bid unit price in the original bid to accomplish this additional work; and,
WHEREAS, the Director of Public Works recommends Change Order No. 1 to the Agreement with Superior Bowen Asphalt Company for the overlay and repair to Cook Road, at an additional cost to the County in the amount of $68,385.50; and,
WHEREAS, these repairs to Cook Road are in the best interests of the health, safety, and welfare of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Change Order No. 1 to the aforesaid contract be, and is hereby, approved, and the County Executive of be, and is hereby authorized to execute said change order on behalf of the County; and,
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
