AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RS (Residential Suburban), a certain 97+ acre tract and approving the preliminary plat "Rolling View Estates," creating an 81-lot residential subdivision.

ORDINANCE 2797, April 6, 1998

 

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RS" (Residential Suburban) District so that there will be transferred from District A to District RS a tract of land described as follows:

                     Description: That part of the West « of the Northwest 1/4 of Section 16, Township 47, Range 30, lying North of U.S. Highway No. 50 as now established; AND the West « of the Southwest 1/4 of Section 9, Township 47, Range 30, except that part in Easley Road; AND that part of the Southwest 1/4 of the Northwest 1/4 of Section 9, Township 47, Range 30, lying South and East of Easley Road as now established. EXCEPT that part thereof described as follows: The South 261 feet of the East 270 feet of the Southwest 1/4 of the Northwest 1/4 of Section 9, Township 47, Range 30, and the North 545.67 feet of the East 270 feet of the Northwest 1/4 of the Southwest 1/4 of Section 9, Township 47, Range 30.  All being in Jackson County, Missouri.  Subject to easements and rights-of-way of record, and further subject to lack of direct access to U.S. Highway No. 50, excepting the right to access reserved in Document No. I-31084 in the Recorder's Office at Independence.

 

 

 

Section 2.  The preliminary plat "Rolling View Estates," creating an 81-lot residential subdivision, is hereby approved.

Section 3.  The Legislature, pursuant to the application of Davis Homes, Inc. (RZ-98-093), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously failed to recommend approval of this application in a public hearing on March 19, 1998, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Attorney

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
