AN ORDINANCE enacting sections 5567., 5567.1, 5567.2, Jackson County Code, 1984, relating to a prohibition on smoking on the exterior premises of County property located at 415 E. 12th Street, Kansas City, MO except for a designated smoking pavilion.

Body

WHEREAS, the Jackson County Courthouse has undergone extensive renovation to preserve and enhance its historic nature; and,

 

WHEREAS, as a part of said renovation a smokers' pavilion was built at the south east corner of the building; and,

 

WHEREAS, it is in the best interest of all employees of Jackson County and the citizens of said County to prohibit smoking on the exterior of this county property except for said smoking pavilion; and

 

WHEREAS, the County Legislature of Jackson County, Missouri has determined that an ordinance should be enacted that prohibits smoking on the exterior of the property at 415 E. 12th Street, Kansas City, MO, except for the designated smoking pavilion; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section A.  Enacting Clause.  Sections 5567., 5567.1, 5567.2, Jackson County Code, 1984, is hereby enacted, to read as follows:

 

5567.  Smoking Prohibited; Except for Designated Areas.

Smoking is prohibited on all of the exterior premises of County property located at 415 E. 12th Street, Kansas City, MO with the exception of any smoking pavilion designated by order of the County Executive.

 

                     5567.1  Posting and Designation.

The perimeter of the exterior premises and all entrances to County property located at 415 E. 12th Street in Kansas City, MO shall be posted No Smoking signs and any designated smoking pavilion will be posted for its intended use.

 

5567.2   Penalty.

Any person who violates the provisions of Section 5567. of this Chapter shall on conviction be punished by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment in the county jail or detention facility for a term not exceeding six (6)  months, or by both.

 

 

 

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
