WHEREAS, Tom Hayes, Jr, James Flanagan and Carl Bolte, Condemnation Commissioners previously appointed by the Judge of Division No. 1 of the Circuit Court of Jackson County, Missouri in Condemnation Case No. CV95-6317, entitled, "Jackson County, Missouri vs. Rosie Burns, et al.", did on the 31st day of August, 1995, file their written report pursuant to law with the Circuit Court in Jackson County, Missouri, assessing damages in favor of the various parties defendant in said case in the aggregate amount of one hundred forty-two thousand, two hundred forty dollars ($142,240.00); and,
WHEREAS, the party defendants, the awards, and the tract numbers are as follows:

WHEREAS, said commissioners' award constitutes a judgment against plaintiff, Jackson County, Missouri, in the aforesaid amount, and that payment thereof is required by law before the County can take legal possession of the condemned land and improvements; therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be and hereby is made from the unappropriated surplus of the 1995 County Urban Road System Fund to cover the commissioner's award:
