Title
AN ORDINANCE authorizing the County Executive to execute a Memorandum of Understanding with the City of Independence, MO, and the City of Lee's Summit, MO and the transfer to and appropriation of $17,750.00 from the unappropriated surplus of the 2005 Grant Fund in acceptance of grant funds awarded to those cities by the U.S. Department of Justice for the purpose of funding an Assistant Prosecuting Attorney position as part of the Coordinated Community Response to Domestic Violence program.

Body
WHEREAS, the U.S. Department of Justice has awarded $7,282.00 to the City of Independence, MO and $2,913.00 to the City of Lee's Summit as part of the Coordinated Community Response to Domestic Violence program; and,
WHEREAS, the City of Independence, MO and the City of Lee's Summit, MO now desire to enter into a memorandum of understanding with the County to provide partial funding for a Jackson County Assistant Prosecuting Attorney position which will be assigned to domestic violence cases and to provide law enforcement training for case preparation; and,
WHEREAS, under the proposed memorandum of understanding incorporating, in part, the terms of 2004 agreements, copies of which are attached hereto as Exhibit A, the City of Independence, MO will provide 50% and the City of Lee's Summit, MO will provide 20% of the salary and benefits for this position commencing May 1, 2005; and,
WHEREAS, the grant period is for a two-year period and the first year of funding ends on September 30, 2005; and,
WHEREAS, matching funds from the County are required in the amount of $7,555.00; and,
WHEREAS, a transfer and appropriation are necessary in order to place the grant funds and matching funds in the proper spending accounts; and,
WHEREAS, the County Executive recommends this appropriation and transfer; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following transfer from the Prosecuting Attorney's 2005 General Fund budget and appropriation from the unappropriated surplus of the 2005 Grant Fund be made:
