AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from District A (Agricultural) to District RE (Residential Estates), a certain 3 ± acre tract.

 Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:  A 3 ± acre tract generally located 1/4 of a mile west of Old Atherton Road on the north side of Union School Road and is specifically described:

 

A tract of land in the SW 1/4 of Section 15, Township 50 North, Range 31 West, more particularly described as follows: Commencing at the NE corner of said 1/4 section; thence N87̊25"11"W along the North line of said 1/4 section, a distance of 664.90 feet to the Point of Beginning, said Point being the Northeast corner of the W ½ of NE 1/4 of the SW 1/4 of said Section; thence S02̊14"56"W along the East line of said W ½ a distance of 50.00 feet to a point, said point being on the proposed South right-of-way line of Courtney Atherton Road; thence S02̊14'56"W continuing along said East line, a distance of 521.22 feet to a point being 750.00 feet N 02̊14'56"E of the Southeast corner of the W ½ of the NE 1/4 of the SW 1/4 of said Section 18; thence N87̊39"40"W parallel with the South line of said 1/4 1/4 Section, a distance of 150.00 feet; thence N02̊14'56"E parallel with the East line of the W ½ of said 1/4 1/4 Section, a distance of 210.00 feet; thence N87̊25'11"W parallel with the North line of the SW 1/4 of said Section 18, a distance of 168.19 feet; thence N02̊14'56"E parallel with the East line of the W ½ of the NE 1/4 of the SW 1/4 of said Section 18, a distance of 361.55 feet to a point on the North line of the SW 1/4 of said Section 18; thence S87̊25"11E along the North line, a distance of 318.19 feet to the POINT OF BEGINNING; containing 3,355 acres, more or less, including that part in Courtney Atherton Road all being subject to easements, rights-of-way, and restrictions of record.

 

Section 2.  The Legislature, pursuant to the application of Kent Strodtman

(RZ-2003-302), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on April 17, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
