AN ORDINANCE extending the boundaries of Salem East Sewer District #95.

 

Intro

ORDINANCE #3694,   October 3, 2005

 

 

Body

 

WHEREAS, the Director of Public Works Department finds that it is in the best interest of County for the health, safety and welfare of the general public to extend the boundary of Salem East Sewer District # 95 to allow the construction of sanitary sewer lines in an area generally located adjacent to the current East boundary of said District; and,

 

WHEREAS, pursuant to the Jackson County Uniform Development Code Section 24003.15 the developer of the Churchill Estates 4th Plat must pay for construction of the sanitary sewer lines in the extended boundary area pursuant to his plat application; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1. Pursuant to Section 249.490, RSMO, et seq., the Director of Public Works recommends to the County Legislature that the boundaries of Sewer District #95 be altered to include the following tract:

Description: A tract of land located in the NW 1/4 of Section 21, Township 50N, Range 31W, in Jackson County, Missouri, more particularly described as follows: Commencing at the SW corner of said NW 1/4; thence N 02 degrees, 33 minutes, 00 seconds E along the west line of said NW 1/4 and the east line of "Churchill Estates 1st Plat", "Churchill Estates 2nd Plat", and "Churchill Estates 3rd Plat", all being subdivisions in Jackson County, Missouri, a distance of 163.82 feet to the POINT OF BEGINNING; thence continuing N 02 degrees, 33 minutes 00 seconds E along said west line, a distance of 1,752.82 feet to the NE corner of said "Churchill Estates 3rd Plat", thence S 87 degrees, 49 minutes, 00 seconds E, a distance of 551.91 feet; thence S 02 degrees, 33 minutes, 00 seconds W parallel with the west line of said NW 1/4, a distance of 1,756.60 feet; thence N 87 degrees, 25 minutes, 30 seconds W, a distance of 551.90 feet to the POINT OF BEGINNING, containing 22 ± acres, more or less.

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
