IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI

 

Title

AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 9.8 ± acre tract, and approving the preliminary plat "KB Hilltop," creating a three (3) lot residential subdivision.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description: A 9.8 ± acre tract of land approximately 1/4 of a mile east of Corn Road on the north side of Spencer Road and specifically described as:

 

A tract of land located in the Southeast Quarter of the Northeast Quarter of Section 23, Township 48 North, Range 30 West in Jackson County, Missouri and being more particularly described as follows:

 

BEGINNING at the Southeast Corner of said Northeast Quarter: THENCE North 87 degrees 40 minutes 23 seconds West, along the South line of said Northeast Quarter, a distance of 652.04 feet; THENCE North 02 degrees 28 minutes 45 seconds East, a distance of 656.41 feet; THENCE South 87 degrees 40 minutes 25 seconds East, a distance of 651.82 feet; THENCE South 02 degrees 27 minutes 35 seconds West,  along the East line of said Northeast Quarter, a distance of 656.42 feet to the point of beginning and containing 427,936 square feet or 9.8241 acres more or less. 

 

Section 2.  The preliminary plat "KB Hilltop," creating a three-lot  residential subdivision, is hereby approved.

 

Section 3.  The Legislature, pursuant to the application of Jo Fenstermaker (RZ-2003-320), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 5 to 1 to recommend this application in a public hearing on September 18, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
