Body
WHEREAS, by Resolution 15086, dated July 6, 2004, the Legislature did authorize the County Executive to execute an Intergovernmental Cooperative Agreement with the City of Lee's Summit, Mo ("City") for improvements to Blackwell and Woods Chapel Roads; and,
WHEREAS, by Resolution 15630, dated September 19, 2005, the Legislature did authorize the County Executive to execute Amendment No. 1 to the original agreement, which added a center turn lane to Woods Chapel Road in an area of new development in the City; and,
WHEREAS, the City and County now desire to include a new and upsized water line, to provide for City in-house inspection of the project and City-furnished materials testing for the project, and to remove the City's financial cap established in the original agreement; and,
WHEREAS, this new amendment provides for a payment of $888,422.00 to the County upon execution of the construction agreement; and,
WHEREAS, the Director of Public Works recommends the approval of the attached Amendment #2 to the Cooperative Agreement; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Amendment #2 to Intergovernmental Cooperative Agreement with the City of Lee's Summit.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
