AN ORDINANCE vacating a certain section of right-of-way on Burris Road.

Body
WHEREAS, Charles Baldwin has requested the vacation of a certain section of right-of-way on Burris Road; and,
WHEREAS, the legal description for the road right-of-way in question is as follows:
The road right-of-way to be vacated is generally located south of where Burris Road pavement ends and is approximately 625 feet in length. The vacated right-of-way shall revert to the owners of adjoining properties as follows:
a) The west 20.00 feet of the south 624.16 feet of the East 15 acres of the south 30 acres of the Southeast Quarter of the Northeast Quarter of Section 2, Township 48, Range 31 in Jackson County, Missouri shall revert to the current abutting property owner to the east.
b) Beginning at the Southeast corner of Lot 1, Pine Crest Estates, a subdivision of land in Jackson County, Missouri; thence North 02 00' 15" East (N 01 54' 35" E Plat) along the East line of Lot 1 of said PINE CREST ESTATES, a distance of 624.16 feet to the Northeast corner of said Lot 1; thence South 88 02' 50" East, a distance of 40.00 feet to a point on the East Line of the Southwest Quarter of the Northeast Quarter of Section 2, Township 48, Range 31; thence South 02 00' 15" West (S 01 54' 35" W Plat) along the East line of the Southwest Quarter of the Northeast Quarter of said Section 2, a distance of 624.16 feet to a point on the South line of the Northeast Quarter of said Section 2, thence North 88 02' 50" West (N 88 08' 23" W Plat) along the south line of the Northeast Quarter of said Section 2, a distance of 40.00 feet to the Point of Beginning shall revert to the current abutting property owner on the west.
WHEREAS, at its meeting of June 18, 1998, the Jackson County Plan Commission took up this request and voted to recommend the vacation; and,
WHEREAS, it is in the best interests of the health, welfare, and safety of the citizens of the County that the described right-of-way on Burris Road be vacated; therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the described right-of-way on Burris Road be and hereby is vacated.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
