Body
WHEREAS, the City of Independence, MO, has submitted a request for a permanent soil nail easement for its Main Street Bridge Replacement over Union Pacific Railroad Spur; and,
WHEREAS, the easement requested, which is described in the attachment, will allow the replacement of the City's Main Street Bridge over Union Pacific Railroad Spur; and,
WHEREAS, the easement will allow the construction of a retaining wall on a corner of the parcel occupied by the Jackson County Health Department, located at 313 S. Liberty in Independence, and will not interfere with the department's use or diminish the value of the tract; and,
WHEREAS, the granting of this easement is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached easement and other associated documents in favor of the City of Independence, Independence, MO.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
