AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 6.3 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:   6.3 ± acres generally located 300 ± feet north of Pink Hill Road on the west side of Owens School Road and specifically described as:

 

LEGAL DESCRIPTION FOR LOT 2, PRAIRIE CREEK:

All that part of the Southeast Quarter of the Southeast Quarter of Section 18, Township 49 North, Range 30 West, Jackson County, Missouri and now being known as Lot 2, PRAIRIE CREEK, and more fully described as follows:

 

Beginning at a point on the last line of the Southeast Quarter of the Southeast Quarter of Section 18, Township 49 North, Range 30 West, Jackson County, Missouri said point being South 01 degrees 34 minutes 04 seconds West (this bearing and all following bearings being State Plane Grid North and referenced to the Kansas City Metro Control Station JA-05, using RTK GPS equipment), 1316.92 feet from the Northeast corner of the Southeast Quarter of said Section 18; thence continue South 01 degrees 34 minutes 04 seconds West, 245.00 feet; thence North 87 degrees 17 minutes 01 seconds West, 616.87 feet; thence North 01 degrees 44 minutes 05 seconds East, 244.99 feet to the North line of the Southeast Quarter of the Southeast Quarter of said Section 18; thence South 87 degrees 17 minutes 01 seconds East, 616.16 feet to the Point of Beginning, said Lot 2 containing 3.467 acres of land, less and except that part in road.

 

LEGAL DESCRIPTION FOR LOT 3, PRAIRIE CREEK:

All that part of the Southeast Quarter of the Southeast Quarter of Section 18, Township 49 North, Range 30 West, Jackson County, Missouri and now being known as Lot 3, PRAIRIE CREEK, and more fully described as follows:

 

Beginning at a point on the East line of the Southeast Quarter of the Southeast Quarter of Section 18, Township 49 North, Range 30 West, Jackson County, Missouri, said point being North 01 degrees 34 minutes 04 seconds East (this bearing and all following bearings being State Plane Grid North and referenced to the Kansas City Metro Control Station JA-05, using RTK GPS equipment), 379.04 feet from the Southeast corner of the Southeast Quarter of said  Section 18; thence North 87 degrees 26 minutes 27 seconds West, 165.00 feet; thence North 01 degrees 32 minutes 21 seconds East 264.00 feet; thence North 87 degrees 17 minutes 06 seconds West, 452.98 feet; thence North 01 degrees 44 minutes 05 seconds East, 1 33.64 feet; thence South 87 degrees 17 minutes 06 minutes East, 617.73 feet to the East line of the Southeast Quarter of the Southeast Quarter of said Section 18; thence South 01 degrees 34 minutes 04 seconds West along the said East line 397.20 feet to the Point of Beginning, said Lot 3 containing 2.895 acres of land, less and except that part in road.

 

 

Section 2.  The Legislature, pursuant to the application of Roland White ( RZ-2003-322), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 5 to 0 to recommend this application in a public hearing on October 16, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
