Body
WHEREAS, the City of Lee's Summit is the owner of approximately 704 acres of land located in the South Prairie Lee watershed, which contains a tributary to the County's Prairie Lee Lake, and which is under development for use as a city park to be known as Legacy Park; and,
WHEREAS, construction and development of Legacy Park has caused silt to accumulate in Prairie Lee Lake; and,
WHEREAS, the City and the County now desire to mutually provide for a means to remedy the siltation problem in Prairie Lee Lake and other lakes of the City and County, and have negotiated the attached Agreement to that end; and,
WHEREAS, under this Agreement the City shall pay to the County one-half of the purchase price and associated start-up costs of the dredging equipment necessary to remove the silt, in an amount not to exceed $163,800.00, with the County to be responsible for the remainder of these costs; and,
WHEREAS, in exchange, the City will be entitled to use the equipment for three months each year; and,
WHEREAS, this arrangement and the execution of the attached Agreement is in the best interest of the health, safety, and welfare of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive and County Counselor be and hereby are authorized to execute the attached Agreement for the Purchase and Use of Sediment Drudging Equipment with the City of Lee's Summit, Missouri, and any and all other documents necessary to resolve all issues pending between the City of lee's Summit and the County regarding siltation in Prairie Lee Lake.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
