Body
WHEREAS, the County and City of Independence desire to cooperate to improve services to their citizens in the use of Anti-Drug Sales Tax funds; and,
 
WHEREAS, the County is in need of an additional facility for the housing of an eastern Jackson County location for its MyARTS drug prevention program and is desirous of cooperating with the City of Independence to secure a suitable facility; and,
 
WHEREAS, the County and City desire to establish a plan for the joint use of a facility owned by the City, located at 315 N. Main Street, which requires environmental remediation before the facility can be renovated; and,
 
WHEREAS, under the proposed arrangement, the City and County would jointly use the facility, including use for the MyARTS program; and,
 
 
WHEREAS, the City has requested the sum of $175,000.00 from the County to be applied towards the cost of the environmental remediation; and,
 
WHEREAS, while environmental remediation is ongoing, the parties will continue to negotiate towards reaching a final agreement concerning  the ownership, operation, and use of the facility, possibly in cooperation with a not-for-profit corporation; and,
 
WHEREAS, the City agrees to refund the County funds if the County and City do not reach a final agreement on the joint use of the facility, consistent with the purposes of the Anti-Drug Sales Tax, within a reasonable period of time; and,
 
WHEREAS, it would be mutually advantageous and to the benefit of both the County and the City to jointly cooperate in proceeding forward on this project in order that a complete and cohesive plan be developed for the greatest benefit of both parties; and,
 
WHEREAS, the attached Cooperative Agreement provides a satisfactory mechanism by which to accomplish this purpose; now therefore,
 
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature authorize the County Executive to execute the attached Cooperative Agreement with the City of Independence; and,
 
 
BE IT FURTHER RESOLVED that the Director of the Department of Finance and Purchasing be and hereby is authorized to make all payments, including final payment on the Agreement, to the extent that appropriated funds are contained in the annual budget.
 
Enacted and Approved
Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
