BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "LB-p" (Local Business-Planned Development) District so that there will be transferred from District A to District LB-p a tract of land described as follows:
Description: The 4.74 ñ acre tract of land generally located 0.2 ñ of a mile south of Colbern Road on the east side of the entrance drive to Lake Lotawana and more specifically described as
All that part of the northeast quarter of the southwest quarter of Section 29, Township 48, North, Range 30 West in Jackson County, Missouri, described as follows: beginning at the Southwest corner of said quarter, quarter section; thence south 87 degrees, 40 minutes, 11 seconds east, along the south line of said quarter, quarter section, a distance of 25.00 feet to a point, said point being on the east right-of-way line of the main entrance road to lake Lotawana; thence north 02 degrees, 08 minutes, 55 seconds east, along the said east right of way line (25.00 feet east of and parallel to the west line of said quarter, quarter section), a distance of 150.00 feet to the true point of beginning of the tract of land to be herein described; thence continuing north 02 degrees, 08 minutes, 55 seconds east along said east right-of-way line, a distance of 200.00 feet; thence south 87 degrees, 40 minutes 11 seconds east along a line 350.00 feet north of and parallel to the south line of said quarter, quarter section, a distance of 781.62 feet to a point 500.00 feet west of the east line of said quarter, quarter section; thence south 01 degrees, 57 minutes, 48 seconds west, along a line 500.00 feet west of and parallel to the east line of said quarter, quarter section, a distance of 350.00 feet to a point on the south line of said quarter, quarter section; thence north 87 degrees, 40 minutes, 11 seconds west, along the said south line, a distance of 335.00 feet; thence north 02 degrees, 08 minutes, 55 seconds east, along a line 447.75 feet east of parallel to the said east right-of-way line, a distance of 150 feet; thence north 87 degrees, 40 minutes, 11 seconds west, along a line 150.00 feet north of and parallel to the south line of said quarter, quarter section a distance of 447.75 feet to the true point of beginning of the tract of land herein described Containing 4.74 acres, more or less.
Section 2. The Legislature, pursuant to the application of Don Avise Memorial VFW Post (RZ-97-066), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission, by a 5 to 1 vote, failed to recommend approval of this application in a public hearing on May 15, 1997, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
