Body
WHEREAS, the Prosecuting Attorney and the Director of Purchasing recommend the appropriation of $12,000.00 from the unappropriated surplus of the 2005 Federal Forfeiture Fund for use by the Prosecuting Attorney's Office in providing funds for the Prosecuting Attorney's ongoing needs for the furnishing of On-Line Legal Publications and Legal Research Services for 2005 Westlaw legal research services; and,
WHEREAS, the County Counselor and the Department of Corrections also have a need for the same Westlaw legal research services; and,
WHEREAS, the Prosecuting Attorney has an existing contract for such services with West Group of Carol Stream, IL; and,
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, pursuant to Sections 1040.1 and 1063. of the Jackson County Code, 1984, the Director of Purchasing has determined that the services to be purchased can be obtained from only one source; and,
WHEREAS, pursuant to Section 1040.1 of the Jackson County Code, 1984, the Director of Purchasing recommends the award a 12 month Term and Supply Contract for the furnishing of On-Line Legal Publications and Legal Research Services to West Group of Carol Stream, IL for use by the Prosecuting Attorney's Office, the County Counselor's Office and the Corrections Department as a sole source purchase; and,
WHEREAS, pursuant to Section 1063.00 of the Jackson County Code, 1984, the Director of Purchasing requests approval by the Legislature of this purchase which may exceed $25,000.00. The Director of Purchasing has determined that the items to be purchased can be obtained from only one source; and,
WHEREAS, this award is made on an as needed basis and does not obligate Jackson County to pay any specific amount. The availability of funds for specific purchases are subject to annual appropriations; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri that the following appropriation be and hereby is made:

BE IT FURTHER ORDAINED that the Director of the Department of Finance is authorized to make all payments to the extent that sufficient appropriations are available.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
