Body
WHEREAS, Jackson County provides essential governmental services to residents living in the unincorporated areas of the County; and,
WHEREAS, residents of unincorporated Jackson County rely upon the County for services including, but not limited to, road and bridge maintenance, stormwater management, code enforcement, public safety support, emergency management, planning and zoning, and infrastructure improvements; and,
WHEREAS, the Legislature finds that the creation of a dedicated fund will promote transparency, accountability, and equitable investment in the needs of unincorporated communities; and,
WHEREAS, the Legislature desires to establish a mechanism by which revenues designated for unincorporated Jackson County may be separately accounted for and expended exclusively for the benefit of those residents and areas; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, as follows:
Section 1. Creation of Fund.
The Legislature hereby establishes the "Unincorporated Jackson County Fund" as a special revenue fund of Jackson County, Missouri.
Section 2. Purpose.
The purpose of the Unincorporated Jackson County Fund shall be to finance projects, services, maintenance, operations, and capital improvements that directly benefit residents and property located within the unincorporated areas of Jackson County.
Section 3. Revenue Sources.
The County Executive, County Auditor, and Director of Finance and Purchasing are directed to identify an account for revenues that may be lawfully deposited into the Fund, including but not limited to:
a. Fees collected from planning, zoning, building permits, inspections, and code enforcement activities within unincorporated Jackson County;
b. Grants and state or federal funds designated for unincorporated areas;
c. Transfers appropriated by the Legislature;
d. Donations, gifts, or other revenues accepted by the County for purposes consistent with this Resolution; and
e. Any other lawful revenue source designated by ordinance or appropriation.
Section 4. Authorized Expenditures.
Monies deposited into the Fund may be expended only upon appropriation by the Legislature and only for purposes that directly benefit unincorporated Jackson County, including but not limited to:
a. Road, bridge, and drainage improvements;
b. Stormwater management projects;
c. Public safety and emergency response enhancements;
d. Neighborhood revitalization and nuisance abatement efforts;
e. Planning, zoning, and code enforcement activities;
f. Parks, trails, recreational amenities, and community facilities located in unincorporated areas; and
g. Other infrastructure or service improvements approved by the Legislature.
Section 5. Annual Reporting.
The County Executive shall submit to the Legislature an annual report detailing:
a. Revenues deposited into the Fund;
b. Expenditures made from the Fund;
c. Current fund balance; and
d. Projects completed, underway, or planned utilizing Fund resources.
Such report shall be submitted no later than March 1 of each year.
Section 6. Implementation.
The County Executive, County Auditor, Director of Finance and Purchasing, and all other appropriate County officials are authorized and directed to take all actions necessary to implement the provisions of this Resolution.
Section 7. Effective Date.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
