INTRODUCED BY Robert A. Stringfield, County Legislator

 

 

 

Body

WHEREAS,  Kenneth McClain, Keith McClain, Bill House and certain entities acting on their behalf, by their admitted trespass on county park land, created a public safety hazard by the evacuation of more than 100,000 cubic yards of dirt, all of which resulted in a large pond that does not meet government requirements of a storm water pond; and,

 

WHEREAS, taxpayers are at risk to the expenditure of public funds as a result of possible liability for damages for injuries to third parties arising from the public safety hazard; now therefore,

 

BE IT RESOLVED the Jackson County Legislature instructs the County Counselor to seek expert opinion on the best method of removing the public safety hazard with a report to the legislature no later  than Monday, May 16, 2005.

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
