AN ORDINANCE amending the zoning districts established by the Unified Development Code by rezoning a certain 10 ± acres from District A (Agricultural) to District RR (Residential Ranchette) District.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:

The 10 ± acres are generally located 3/4 of a mile east of Missouri Route F (Outer Belt Road) on the south side of Nevins Road and specifically described as all that part of the East Half of the West Half of the Northeast Quarter of the Southeast Quarter of Section 21, Township 48 North, Range 29 West, all in Jackson County, Missouri, and more fully described as follows:  Commencing at the Northeast corner of the Southeast Quarter of Section 21, Township 48 North, Range 29 West, thence North 87 degrees 52 minutes 52 seconds West (this bearing and all following bearings being State Plane Grid North, as established using R.T.K. G.P.S. equipment, and referenced to Kansas City Metro Control Station JA-78), a distance of 662.35 feet along the North line of the Southeast Quarter of said Section 21, said point being the Point of Beginning; thence South 01 degrees 50 minutes 12 seconds West, along the East line of East Half of the West Half of the Northeast Quarter of the Southeast Quarter of said Section 21, a distance of 1310.74 feet to the Southeast corner of the East Half of the West Half of the Northeast Quarter of the Southeast Quarter of said Section 21; thence North 87 degrees 46 minutes 37 seconds West, a distance of 331.50 feet to the Southwest corner of the East Half of the West Half of the Northeast Quarter of the Southeast Quarter of said Section 21; thence North 01 degrees 50 minutes 13 seconds East, along the West line of the East Half of the West Half of the Northeast Quarter of the Southeast Quarter of said Section 21, a distance of 1310.14 feet to the North line of said Section 21; thence South 87 degrees 52 minutes 52 seconds East along said North line of Section 21, a distance of 331.18 feet to the point of Beginning aka 40103 E. Nevins Road.

 

 

Section 2.  The Jackson County Plan Commission, on April 21, 2005, held a public hearing and accepted testimony pertaining to the change of zoning requested by Charles Yewell.  This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 8 to 0 to recommend APPROVAL to the County Legislature.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
