Title

AN ORDINANCE amending the zoning districts established pursuant to the Unified Development Code by changing from District A (Agricultural) to District RE (Residential Estates) a certain 39.4 ± acre tract, and approving the preliminary plat "Timber Ridge Meadows," creating an eleven-lot residential subdivision.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

The 39.4 ± acres are approximately located at the southwest corner of Union School Road and Old Atherton Road and specifically described as part of the Northeast Quarter of Section 16, Township 50, Range 31, lying west of the Public Road, known as the Independence & Atherton road, more particularly described as:

 

Description: Commencing at the northeast corner of Section 16, Township 50, Range 31, thence north 87̊39'54" west, 1857.67 feet to the Point of Beginning thence south 08̊14'32" west, 730.00 feet; thence north 02̊14'32" east, 730.00 feet to the northwest corner of the Northeast Quarter of said Section 16; thence south 87̊39'54" east along the north line of said Northeast Quarter, 769.90 feet to the Point of Beginning, containing 12.91 acres more or less.

 

ALSO: a part of the Northeast Quarter of Section 16, Township 50, Range 31, lying west of the Public Road, known as the Independence & Atherton road described as follows:

 

Description: Commencing at the northeast corner of Section 16, Township 50, Range 31, thence north 87̊39'54" west, 678.46 feet; thence south 01̊58'01" east, 203.62 feet; thence south 88̊01'59" west, 30.00 feet; thence south 01̊58'01" east 400.00 feet; thence north 88̊01'59" east, 40.00 feet; thence south 01̊58'01" east, 128.80 feet to the Point of Beginning; thence continue south 01̊58'01" east, 305.99 feet; thence south 07̊46'52" west, 289.21 feet; thence north 87̊39'21" west, 733.54 feet; thence north 04̊55'17" east, 593.52 feet; thence south 87̊39'54" east, 711.25 feet to the Point of Beginning, containing 10.00 acres, more or less.

Section 2.  The preliminary plot "Timber Ridge Meadows" creating an eleven -lot residential subdivision, is hereby approved.

 

Section 3. The Legislature, pursuant to the application of Steven McBee (RZ-2008-450), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on April 17, 2008, does adopt this Ordinance pursuant to the Jackson

County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
