Body
WHEREAS, the City of Lee's Summit has requested, in connection with its Tudor Road and Scruggs Road improvement projects, the conveyance of a right-of-way and permanent storm drainage and temporary construction easements through a portion of south Prairie Lee Lake Park; and,
WHEREAS, the right-of-way and easements requested, which are described in the attached conveyance instruments, are a permanent right-of-way totaling 28,432.79 square feet, a permanent drainage easement across land totaling 10,700.68 square feet in area, and a temporary construction easement across an additional 25,514.15 square feet of land; and,
WHEREAS, the National Park Service and Missouri Department of Natural Resources have reviewed these easements requests and have approved same, conditioned on the execution of the attached Project Amendment and substitution of equivalent property; and
WHEREAS, the granting of these easements is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached conveyance instruments in favor of the City of Lee's Summit, Missouri; and,
BE IT FURTHER RESOLVED that the County Executive be and hereby is authorized to execute the attached Project Amendment with the Missouri Department of Natural Resources.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
