IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE repealing sections 739. and 950., Jackson County Code, 1984, relating to former county officers and employees and conflicts of interest, and enacting, in lieu thereof, two new sections relating to the same subjects, with a penalty provision. Intro ORDINANCE #2385, March 6, 1995 INTRODUCED BY James D. Tindall, County Legislator Body WHEREAS, 105.476, RSMo 1994, gives the Legislature the power to adopt reasonable restrictions to govern the conduct of former county officers and employees regarding current county business and decisions; and, WHEREAS, 739. of the Jackson County Code currently contains such a restriction with regard to property tax matters; and, WHEREAS, the adoption of additional restrictions, identical to those already found in state law, a e in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows: Section A. Enacting Clause. Sections 739. and 950., Jackson County Code, 1984, are hereby repealed and two new sections enacted in lieu thereof, to be known as sections 906. and 950., to r ad as follows: [739. Former Employees and Elected Officials. No managing officer or supervisory personnel or elected officials of Jackson County, Missouri shall perform any service for consideration as an employee of a company or as an individual during a period of five (5) years after termination of the employment of that person with Jackson County, Missouri, by which performance that person attempts to influence a decision of the Assessment Operations Sections of the Property Tax Division or before the Board of Equalization in an adversary hearing before that board may be defined by Section 105.450(1) RSMo (1978). This section is enacted pursuant to authority provided for by Section 105.476 RSMo (1978).] 906. Conflicts of Interest, Former Officers and Employees. The following are prohibited conflicts of interest for former officers and employees: 906.1 Influence Decisions of County, One-Year Prohibition. No former elected or appointed county officer or employee, who served in an executive or administrative capacity, shall perform any service for consideration, during one year after termination of his office or employment, by which performance he attempts to influence a decision of the county, except that this subsection shall not be construed to prohibit any person from performing such service and receiving compensation therefor, in any "adversary proceeding" or in the preparation of filing of any "public document," as those terms may be defined in 105.450, RSMo. 906.2 Property Tax Matters, Five-Year Prohibition. No former elected or appointed county officer or supervisory employee shall perform any service for consideration, during five years after termination of his office or employment, by which performance he attempts to influence a decision of the Assessment Department of the Division of Finance or of the Board of Equalization. 906.3 Personal Participation, Permanent Prohibition. No former elected or appointed county officer or employee, who served in an executive or administrative capacity, shall perform any service for any consideration for any person, firm or corporation after termination of his office or employment in relation to any case, decision, proceeding, or application with respect to which he was directly concerned or in which he personally participated during the period of his service or employment. 950. Penalty, Violation of Personnel Code Provisions. Any person who knowingly violates any provision of this chapter commits a county ordinance violation and, if convicted, for the first offense shall be fined not more than five hundred dollars ($500) or be sentenced to not more than six (6) months in the county jail or both, and, for the second and subsequent offenses, shall be fined not more than one thousand dollars ($1,000) or be sentenced to not more than one (1) year in the county jail or both. Attorney Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
