AN ORDINANCE approving an amendment to an existing conditional use permit to operate a child day-care center as to a certain 5 ± acre tract.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  An amendment to an existing conditional use permit, to expire December 4, 2005, to operate a child day-care center, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:

Section 2.  The amended conditional use permit granted by this ordinance is subject to the following conditions:

 

1.                     That the applicant comply with all State and County regulations relative to a Child Day Care Center being operated under the Conditional Use Permit.  Upon renewal of State and County Permits, the applicant shall provide copies to the Public Works Development Division.

 

2.                     That the Child Day Care Center shall be limited to the maximum number of children permitted by the Missouri Department of Health or 60 children whichever number is less.

 

 

3.                     That the on-site area designated for wastewater disposal be isolated to the extent that it will not be accessible to children.

 

4.                     That all driveways and parking areas located on subject tract be surfaced and paved.

 

5.                     The outdoor play area of the child day care center shall be enclosed with a fence, which shall be built and maintained to a minimum height of four (4) feet.

 

6.                     The Child Day Care Center shall be operated only between the hours of 6:00 a.m. and 6:00 p.m., Monday through Friday.

                                                                                                                              

 

Section 3.  The Legislature, pursuant to the application of Little Einsteins Learning Center (CU-2001-154), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on May 17, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
