IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE imposing in Jackson County, Missouri, a retail sales tax of one-eighth (1/8) of one cent for the restoration of Union Station and the construction of a science museum at Union Station. Intro ORDINANCE 2609, November 25, 1996 INTRODUCED BY Victor E. Callahan, County Legislator Body WHEREAS, the legislatures of Kansas and Missouri have each enacted the Kansas and Missouri metropolitan culture district compact, codified at K.S.A. 12-2536 et seq. and 70.500 et seq., RSMo, as amended, which was approved by the 103rd United States Congress in 1994, pursuant to United States House of Representatives Resolution 4896, creating the ability of certain counties in Kansas and Missouri to form a metropolitan culture district; and, WHEREAS, the governors of Kansas and Missouri appointed Task Forces to study, review and recommend action with regard to the metropolitan culture district, and those Task Forces having unanimously recommended to the county governing bodies of Johnson and Wyandotte in Kansas and Jackson, Clay and Platte in Missouri, that a metropolitan culture district should be created, and that a retail sales tax of one-eighth (1/8) of one cent be levied for the purpose of restoring Union Station and the creation of a science museum at Union Station, and that the tax levy shall terminate upon the collection of $118,000,000 from the district; and, WHEREAS, restoration of Union Station and construction of Science City represents an historic opportunity for cooperation among the citizens of the metropolitan area to be served by the District; and, WHEREAS, the Legislature has determined that the report and recommendations of the Task Forces should be accepted; that the creation of and participation in the metropolitan culture district, as recommended, is in the best interests of the citizens of the County; that the levy of a tax, as recommended by the Task Forces, for financial support of the district on a cooperative basis with other counties would be economically practical and cost beneficial to the citizens of the County; and that the citizens of the participating counties should be given the opportunity to vote upon implementing the metropolitan culture district; and, WHEREAS, by Ordinance 2566, dated July 22, 1996, the Legislature did submit to the qualified voters of the County at the general election held on November 5, 1996, a question authorizing participation in the District and approving a retail sales tax of one-eighth (1/8) of one cent for the restoration of Union Station and the construction of a science museum at Union Station; and, WHEREAS, at that election, the voters of Jackson County, as well as those of Platte and Clay Counties, Missouri, and Johnson County, Kansas, approved the question submitted, and thus authorized the creation of the District and the imposition of the sales tax; and WHEREAS, 70.507, RSMo Supp. 1995, requires that the Legislature now adopt an ordinance actually imposing the tax, in order for the tax to be effective; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:. Section 1. Tax Imposed. Pursuant to the provisions of 70.500 et seq., RSMo, as amended, there is hereby imposed in Jackson County, Missouri, a countywide sales tax at the rate of one-eighth (1/8) of one cent (.125%) for financing the Kansas and Missouri Metropolitan Culture District, the proceeds of which are to be used for restoration of Kansas City's Union Station and the construction of a science museum at Union Station. Section 2. Effective and Expiration Dates The tax imposed by this Ordinance shall become effective on the first day of the second calendar quarter after the Director of the Missouri Department of Revenue receives notice of the adoption of the tax, April 1, 1997, and shall terminate on the first day of the second calendar quarter after the Director of the Missouri Department of Revenue receives notice that the total sum of $118,000,000 has been collected in the Kansas and Missouri metropolitan culture district, which includes Jackson, Clay, and Platte Counties, Missouri, and Johnson County, Kansas, and may later include Wyandotte County, Kansas. Section 3. The Clerk of the Legislature is hereby directed to transmit a certified copy of this Ordinance to the Director of the Missouri Department of Revenue, by registered or certified mail, so as to arrive on or before December 31, 1996. Attorney Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
