IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI
Title
AN ORDINANCE appropriating $6,000.00 from the unappropriated surplus of the 2004 Federal Forfeiture Fund and authorizing the Purchasing Director to issue purchase orders for the purchase of legal publications for use by the Prosecutor's Office ($15,600.00) and the Department of Corrections ($18,200.00) to West Group of Carol Stream, IL, as a sole source purchase, in the actual amount of $33,800.00.

Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends the purchase of legal publications for use by the Prosecutor's Office and the Department of Corrections to West Group of Carol Stream, IL; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said purchase for the reason that West Group is the only supplier of these legal publications in the format required with the West head note system; and,
WHEREAS, in order to fund this expenditure, an appropriation is necessary; and,
WHEREAS, the County Executive recommends this appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be and hereby is made from the unappropriated surplus of the 2004
Federal Forfeiture Fund:

BE IT FURTHER ORDAINED that the Manager of the Division of Finance be and hereby is authorized to make all payments including final payment on the contract thereby made.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
