WHEREAS, the Director of Public Works, at the request of the Parks and Recreation Department, has solicited formal written bids on Bid No. PW-02-97 for the Longview Golf Course Cartpath Replacement, Phase I, Project No. 2346; and,
WHEREAS, he has received as the lowest three bids thereon the following:

Gervy Construction Company $146,241.80
Independence, MO
D. F. Freeman Contractors, Inc. $172,395.90
Shawnee, KS
and,
WHEREAS, the Purchasing Director has recommended that award be made to Pyramid Excavation and Construction, Inc., of Shawnee, KS, for the reason that its the lowest and best bid submitted; and,
WHEREAS, the construction documents reserve the right to increase the quantity of materials in order to fully utilize funds available for this project, which would increase the actual contract price to $133,347.65; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that a contract on Bid No. PW-02-97 in the actual amount of $133,347.65, be awarded to Pyramid Excavation and Construction, Inc., of Shawnee, KS, as the lowest and best bidder; and,
BE IT FURTHER RESOLVED that the Purchasing Director be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments, except final payment on the contract.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
