AN ORDINANCE enacting section 5547., Jackson County Code, 1984, relating to petty offense and domestic assault.

ORDINANCE NO. 5849, May 20, 2024

Body

 WHEREAS, it is the desire of the Jackson County Legislature to ensure the safety and security of all of Jackson County citizens; and,

 

WHEREAS, the Legislature desires to create a new section in Chapter 55 regarding petty offenses related to the subject of domestic assault; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

Section A.  Enacting Clause

Section 5547., Jackson County Code, 1984, is hereby enacted, to read as follows:

 

5547. Domestic Assault.

A person commits the offense of domestic assault if the act involves any family or household member or an adult who is or has been in a continuing social relationship of a romantic or intimate nature with the actor, as defined in RSMo 455.010, including all children residing in the home and:

 

a. The person attempts to cause or recklessly causes physical injury, illness, or pain to such a family or household member; or

b. With criminal negligence the person causes physical injury to such family or household member by means of a deadly weapon or dangerous instrument; or

 

c. The person purposely places such family or household member in apprehension of immediate physical injury by any means; or

 

d. The person recklessly engages in conduct which creates a substantial risk of death or serious physical injury to such family or household member; or

 

e. The person knowingly causes physical contact with such family or household member knowing the other person will regard the contact as offensive; or

 

f. The person knowingly attempts to cause or causes the isolation of such family or household member by unreasonably and substantially restricting or limiting such family or household member’s access to other persons, telecommunication devices or transportation for the purpose of isolation.

 

 

 

Enacted and Approved

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
