Body

WHEREAS, the City of Lee's Summit has requested, and the Public Works Director has recommended, rights of way, a temporary construction easement, and a permanent drainage easement from the County to serve the Woods Chapel Road Improvement project; and,

WHEREAS, the aforementioned rights of way and easements are necessary for the project and there is no practical way to avoid the use of County property; and,

WHEREAS, the granting of the requested rights of way and easements is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

BE IT RESOLVED  by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute rights of way, a temporary construction easement, and a  permanent drainage easement in favor of the City of Lee's Summit, in forms to be approved by the County Counselor.

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
