Body

WHEREAS, certain sections of chapter 2 of the County Code, relating to County governmental operations, have not been reviewed and revised in over twenty years; and,

 

WHEREAS, in the interim, other sections have been enacted that conflict with these older sections; and,

 

WHEREAS, certain sections relating to the County Counselor and Public Administrator  have become particularly outdated and obsolete; and,

 

WHEREAS, the amendments proposed in this Ordinance are in the best interests of the health, welfare, and safety of the citizens of the County; now therefore,

 

BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:

 

Section A.                       Enacting Clause.  Sections 240., 276., and 285.,  Jackson County Code, 1984, are hereby repealed, and three new sections enacted in lieu thereof, to be known as sections 240., 276., and 285., to read as follows:

 

240.  County Counselor, Staff Authorized.

The County Counselor shall have [a] such staff [of not more than five (5) assistant county counselors who devote full time to their duties; not more than six (6) associate county counselors who employment may be part time; and not more than four (4) secretaries] as may be authorized in the annual budget.  All [assistant and associate county counselors] lawyers in the County Counselor's Office shall serve at the pleasure of the County Counselor.

 

276.                     Public Administrator, Salary.

The Public Administrator of Jackson County, Missouri shall receive an annual salary [of seventy-five thousand and five dollars ($75,0005.00)]  as determined pursuant to section 285. of this chapter.

                                                                                                                                                                                             

                     [276.1 Hired After Effective Date of Ordinance.

If the Public Administrator begins employment with Jackson County subsequent to the effective date of Ordinance #1854, that person shall receive a salary of seventy-five thousand and five dollars ($75,005.00).  The setting of this salary at $75,005.00 shall not prohibit the Public Administrator from receiving cost of living increases if provided by the Legislature.]

 

285.                     Employees not within the Merit System.

The salary ranges for compensation of County employees not within the Merit System are hereby adopted as set forth in Schedules I through IX.

 

                     285.1.                     Authority to set specific salaries within ranges.

The County Legislature, by majority vote of its members, the County Executive, the Prosecuting Attorney, the Sheriff, the County Counselor, [the Anti-Drug Sales Tax Fiscal Commission,] and the Commission on Human Relations and Citizens Complaints shall have the authority to set salaries for employees not within the Merit System on their respective staffs within the salary ranges set out by ordinances.    For the purposes of this subsection, the staff of the County Legislature shall include the Legislature's immediate staff as well as all employees not within the Merit System in the offices of the Clerk of the County Legislature, [Medical Examiner, Public Administrator,] County Auditor, Compliance Review Officer, and all other County employees not within the Merit System not expressly described herein.  For the purposes of this subsection, the staff of the County Executive shall include the Executive's immediate staff, [specifically two administrative aides and the public information officer,] as well as the staffs of the Medical Examiner and Public Administrator and all employees not within the Merit System in the Jackson County Division of [Administration, Finance, Operations and Property] Financial Services, Operations, and Intergovernmental Relations and Communications.

 

(a)                     Each County Legislator shall determine salary ranges for his or her aide(s) within each legislator's annual budget.  The setting of salaries for legislative aides will be within the sole discretion of each legislator within each legislator's budgetary constraints.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
