WHEREAS, there is now pending in the Circuit Court of Jackson County, Missouri, the case of In the Matter of the Estate of Leonore Ritter, Maurice A. Ritter v. Frank Murphy and Fidelity and Deposit Company of Maryland, Case No. PR95-031982-03, wherein the plaintiff seeks damages against Frank J. Murphy, et al., relative to the conservatorship of his mother's estate; and,
WHEREAS, the Jackson County Counselor has recommended that it is in the best interest of the health, welfare, and safety of the citizens of Jackson County that all of the plaintiff's claims be settled for the payment of $17,700.00 to petitioner/plaintiff, as more specifically explained and detailed to the Jackson County Legislature by the County Counselor in closed session related to this litigation; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be, and hereby is, authorized to settle the case of In the Matter of the Estate of Leonore Ritter, Maurice A. Ritter v. Frank Murphy and Fidelity and Deposit Company of Maryland, Case No. PR95-031982-03 pending in the Circuit Court of Jackson County, Missouri, at Independence, Probate Division, for a total payment of $17,700.00, in full, final, and complete release of Frank J. Murphy, Frances A. Rove, James P. Aylward, Jr., the Jackson County, Missouri Public Administrator's office and all of its employees, officers, agents, and servants; and Fidelity and Deposit Company of Maryland; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to issue the check of Jackson County, Missouri in the total amount of $17,700.00 to petitioner/plaintiff pursuant to instructions of the Jackson County Counselor...Attorney
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
