AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 34.2 ± acre tract, and approving the preliminary plat "Stonehaus Farms South" creating a ten-lot residential subdivision.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description: A 34.2 ± acre tract of land generally south of Colbern Road and west of 97th Street and specifically described as a tract COMMENCING at the Southwest corner of the Southwest quarter of Section 25, Township 48, Range 31, Jackson County, Missouri; thence North 02 degrees 13 minutes 13 seconds East along the west line of said Southwest quarter, a distance of 1359.70 feet; thence South 87 degrees 46 minutes 47 seconds East a distance of 603.63 feet to a point on a curve; thence along a curve to the right said curve having an initial tangent bearing of North 59 degrees 32 minutes 09 seconds a central angle of 18 degrees 57 minutes 40 seconds a radius of 275.00 feet and an arc length of 91.01' to a point of tangency, thence North 78 degrees 29 minutes 49 seconds East, a distance of 386.16 feet to a point of curvature; thence along a curve to the right, said curve having a central angle of 12 degrees 16 minutes 27 seconds a radius of 325.00 feet and an arc length of 69.62 feet to a point of tangency; thence South 89 degrees 13 minutes 45 seconds East, a distance of 50.00 feet to a point on a curve; thence along a curve to the left, said curve having an initial tangent bearing of South 24 degrees 57 minutes 55 seconds West a central angle of 48 degrees 23 minutes 21 seconds a radius of 61.00 feet and an arc length of 51.52 feet; thence North 89 degrees 13 minutes 45 seconds West, a distance of 44.36 feet; thence South 03 degrees 17 minutes 02 seconds West, a distance of 550.53 feet; thence  South 19 degrees 54 minutes 51 seconds West, a distance of 405.78 feet; thence South 01 degree 53 minutes 25 seconds West, a distance of 503.53 feet to a point on the South line of said Southwest quarter; thence North 88 degrees 06 minutes 35 seconds West along said south line, a distance of 1007.18 feet to the POINT OF COMMENCEMENT. Contains 34.22 acres, more or less.                                                               

 

Section 2.  The preliminary plat "Stonehaus Farms South" creating a ten-lot residential subdivision, is hereby approved.

 

Section 3. The Legislature, pursuant to the application of Kenneth Euritt (RZ-2002-268), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted 8 to 1 to recommended this application in a public hearing on May 16, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
