AN ORDINANCE requesting a renewal of a conditional use permit (CUP) in District AG (Agricultural) for continuous operation of a horse boarding facility subject to specified conditions, as to a 48.09± acre tract.

ORDINANCE NO. 6054, February 2, 2026

 

 

Body

 BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

 

Section 1. A conditional use permit is hereby requested for continuous operation of a horse boarding facility as to a 48.09± acre tract, commonly known as 33800 East Hammond Road, and legally described as follows:

Description: The Northeast Quarter of the Southeast Quarter of Section 35, Township 48, Range 30, except all that part of the Northeast Quarter of the Southeast Quarter of Section 35, Township 48, Range 30, described as follows: Commencing at the East Quarter corner of said Section 35; thence South 02 degrees 15 minutes 18 seconds West, along the East line of said Section 35, a distance of 120.00 feet; thence South 58 degrees 37 minutes 09 seconds West, a distance of 1086.90 feet; thence North 88 degrees 11 minutes 23 seconds West and parallel to the North line of the Northeast Quarter of the Southeast Quarter of said Section 35, a distance of 400.00 feet to a point on the West line of the Northeast Quarter of the Southeast Quarter of said Section 35; thence North 01degrees 54 minutes 00 seconds East along the West line of the Northeast Quarter of the Southeast Quarter of said Section 35, a distance of 715.00 feet to the Northwest corner of the northeast Quarter of the Southeast Quarter of said Section 35; thence South 88 degrees 11 minutes 23 seconds East along the North line of the Northeast Quarter of the Southeast Quarter of said Section 35, a distance of 1309.38 feet to the point of beginning,

 

And,

 

The West 26 acres of the Southeast Quarter of the Southeast of Section 35, Township 48, Range 30, Jackson County, Missouri, except that part platted as Meyers Acres, and except part in road, all in Jackson County, Missouri.

 

 

Section 2.  The conditional use permit granted by this Ordinance is subject to the following conditions:

1. The number of horses is limited to no more than 19.

Section 3.  The Legislature, pursuant to the application of Ruth L. McCulloch, (CU-2025-257), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 7 to 0 to recommend APPROVAL of this application in a public hearing on November 20, 2025, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Enacted and Approved

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
