AN ORDINANCE submitting to the qualified voters of Jackson County, Missouri, a proposition to amend the Jackson County Charter by repealing said Charter in its entirety and enacting an amended Charter in lieu thereof.

Body
WHEREAS, the Charter Task Force appointed by the County Executive has recommended that an amended Charter be adopted by the County Legislature and submitted to a vote of the qualified voters of Jackson County, Missouri, as set forth in the document entitled Proposed 2010 Jackson County Charter; and,
WHEREAS, the County Executive recommends the adoption of the proposed Charter Amendment which provides for repeal of the current Charter and adoption of the Proposed 2010 Jackson County Charter; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri that there is hereby submitted to the qualified voters of Jackson County, Missouri for approval or disapproval a proposition to amend the Jackson County Charter as set forth in the document entitled Proposed 2010 Jackson County Charter at the primary election to be held in Jackson County, Missouri on the first Tuesday next following the first Monday in August, 2010.
- Section The Jackson County Charter adopted by vote on November 3, 1970, and as amended in public vote on August 8, 1978, April 2, 1985, November 4, 1986 and August 2, 1994 is hereby repealed and the Proposed 2010 Jackson County Charter as filed in final form with the Clerk of the Legislature on May 25, 2010, is hereby adopted in lieu thereof as the 2010 Jackson County Charter.
- Section The qualified voters at said election shall vote by ballot and the ballots to be used at said election shall contain the following language:

- Shall the Jackson County Charter adopted by vote on November 3, 1970, and as amended in public vote on August 8, 1978, April 2, 1985, November 4, 1986 and August 2, 1994 be repealed and the Proposed 2010 Jackson County Charter, as filed in final form on May 25, 2010 with the Clerk of the Legislature, be enacted in lieu thereof as the 2010 Jackson County Charter.

- If you are in favor of the question, place an "x" in the box opposite "Yes." If you are opposed to the question, place an "x" in the box opposite "No."
- Section If a majority of the qualified voters voting at said election shall vote in favor of the approval of this ordinance, the Proposed 2010 Jackson County Charter, shall be binding and shall become effective August 23, 2010 as the 2010 Jackson County Charter.
- Section The Clerk of the Legislature is hereby authorized and directed to notify the Jackson County and Kansas City Boards of Election Commissioners of the adoption of this Ordinance no later than 4:00 p.m. on May 25, 2010, and to include in said notification all of the terms and provisions required by ยง115.125, RSMo 2000.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
