Body
WHEREAS, the City of Independence has requested a permanent drainage easement from the County to allow installation, operation, and maintenance of a stormwater transmission main through Little Blue Trace Park to serve the Eastland Center development project; and,
WHEREAS, the aforementioned easement is necessary in order to provide flood protection and improve services to the Eastland Center and there is no practical way to avoid the use of County property; and,
WHEREAS, the granting of this easement is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute a permanent drainage easement in favor of the City of Independence, in a form substantially similar to that attached, as approved by the County Counselor.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
