AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 21.2 ± acre tract, and approving the preliminary plat "R&R Estates 2nd Plat, Lots 5 thru 8," creating a four lot residential subdivision.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description: A 21.2 ± acre tract of land generally located 1/4 mile south of Stony Point School road on the east side of Arnette Road and more specifically described:

 

All that part of the East Half of the Southeast Quarter of Section 9, Township 48 North, Range 30 West in Jackson County, Missouri, and more fully described as follows:

 

Commencing at the Northeast corner of the Southeast Quarter of Section 9, Township 48 North, Range 30 West; thence North 89 degrees 48 minutes 07 seconds West along the North line of said East Half of Southeast quarter of Section 9, a distance of 462.77 feet to the Northeast corner of Lot 2, R&R ESTATES a subdivision in Jackson County, Missouri; thence South 00 degrees 14 minutes 29 Seconds West, along the East line of said Lot 2, 401.45 feet to the True Point of Beginning; thence South 00 degrees 14 minutes 29 West a distance of 541.14 feet; thence South 89 degrees 48 minutes 07 seconds East a distance of 55.70 feet; thence South 00 degrees 19 minutes 15 seconds West a distance of 249.17 feet; thence North 89 degrees 48 minutes 07 seconds West a distance of 874.05 feet to a point on the East right-of-way of Arnette Road,  as now established (40 feet from the center line thereof); thence South 00 degrees 17 minutes 28 seconds West along East right-of-way line of Arnette Road a distance of 60.00 feet; thence South 89 degrees  48 minutes 07 seconds East a distance of 665.72 feet; thence South 00 degrees 19 minutes 02 seconds West a distance of 327.78 feet to the Northeast corner of Lot 3, ARNETTE ACRES, a subdivision in Jackson County, Missouri; thence North 89 degrees 38 minutes 05 West, along the North line of said ARNETTE ACRES, a distance of 705.55 feet, to the west line of said East half, Quarter, Section, thence North 00 degrees 17 minutes 28 seconds East, along the West line of said East Half of Southeast Quarter of Section 9 a distance of 1176.04 feet; thence South 89 degrees 48 minutes 07 seconds East, along South Line of said R&R ESTATES  a distance of 857.99 feet, to the Point of Beginning. Except that part in road. Containing 21.239 acres more or less.

 

Section 2. The preliminary plat "R&R Estates 2nd Plat, Lots 5 thru 8," creating a four lot residential subdivision, is hereby approved.

 

 Section 3.  The Legislature, pursuant to the application of Stanford Green (RZ-2001-228), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on April 19, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
