A RESOLUTION recommending on an interim basis until the Jackson County Ethics Commission meets and establishes procedures for the receipt and investigation of such complaints that all conflict of interest complaints be referred to the Office of the Prosecuting Attorney.

Body
WHEREAS, the Jackson County Ethics Commission was created by amendments to the Jackson County Home Rule Charter; and,
WHEREAS, pursuant to Article XII, Section 7.4, of the Jackson County Charter, the Ethics Commission may adopt rules and procedures necessary to carry out its powers and duties; and,
WHEREAS, a member of the Legislature has been told that the Ethics Commission has not met for a period of several months and does not have established rules and procedures for the receipt of conflict of interest complaints; and,
WHEREAS, the rights of all Jackson County citizens are adversely effected by the failure of the Ethics Commission to have such rules and procedures; and
WHEREAS, pursuant to Article XII, Section 4 of the Jackson County Charter, the Legislature may enact ordinances to guard against injustices and to supplement the provisions and extend prohibitions against conflicts of interests consistent with the other provisions of Article XII; and,
WHEREAS, pursuant to Article XII, Section 6.3 of the Jackson County Charter, the Ethics Commission may be assisted by County officials in carrying out its functions; and,
WHEREAS, pursuant to Article XII, Section 6.4 of the Jackson County Charter, the Ethics Commission may turn over any apparent violation of law to the appropriate authorities; and,
WHEREAS, the County Legislature believes it is imperative that all conflict of interest complaints should be addressed in the interim; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature recommends that conflict of interest complaints concerning Jackson County officers, employees and board or commission members as well as lobbyists dealing with Jackson County be filed with the Office of the Prosecuting Attorney until such time as the Ethics Commission establishes rules and procedures; and,
BE IT FURTHER RESOLVED that the Legislature recommends that the Prosecuting Attorney promptly forward the original of the complaint to the Ethics Commission but retain a copy in his office as a confidential record for investigation by his office whether or not the Ethics Commission chooses to take action on any complaint.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
