Body
WHEREAS, the Director of Public Works has solicited formal written bids on Bid No. PW 04-2011 for the 2011 Pavement Maintenance Project Phase 1 (asphaltic concrete overlay, chip seal, and pavement marking), No. 3142; and,
 
WHEREAS, he has received two responses as follows:
            VENDOR                                    BID
 
      Superior Bowen Asphalt Co.                  $1,404,999.33
            Kansas City (Jackson County), MO
 
      Metro Asphalt, Inc.                              $1,567,976.83
            Independence, MO
 
      
 
and,
 
WHEREAS, the Director of Public Works recommends that the contract be awarded to Superior Bowen Asphalt Co., LLC, for the reason that it has submitted the lowest and best bid; and,
 
 
WHEREAS, the County reserved the right to adjust the quantities up or down to any and all bids to accommodate available funds within the bid specifications; and,
 
WHEREAS, the bids for parks work came in under the available funds and the Parks and Recreation Department desires to increase the contract award within the budgeted funding to pay for additional work and the contract provides for a liquid asphalt price adjustment with a $50,000.00 cap to account for any variance in price for the liquid asphalt part of the project; and,
 
WHEREAS, in the event that line item adjustments to the contract become necessary, it is appropriate that the Director of Public Works be authorized to approve said line item adjustments to the extent there is no additional cost to the County; now therefore,
 
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Director of Public Works and that the County Executive be and hereby is authorized to execute any documents necessary to the accomplishment of the award; and,
 
BE IT FURTHER RESOLVED that the Director of Public Works be and hereby is authorized to make adjustments in  the contract line item quantities to the extent that there will be no further funding obligation to the County; and,
 
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.
 
Enacted and Approved
Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
