Body
WHEREAS, the City of Blue Springs, Missouri ("City") presently uses a tract of County-owned land located on Quarry Road, south of U.S. 40 Highway, under the terms of a 1968 easement expiring in 2018, as recommended by the then County Highway Engineer, Harvey A. Jones, and authorized by the County Court of Jackson County, Missouri; and,
WHEREAS, said tract of land was originally used by the City for sewage treatment purposes; and,
WHEREAS, the City now desires to obtain fee simple title to a portion of this tract of land as described in the attached conveyance instrument and use it in connection with a City bike trail project and related public works; and,
WHEREAS, article II, § 16.25 of the Jackson County Charter authorizes the Legislature to transfer County property to cities upon terms it deems advantageous to the County; and,
WHEREAS, the City has obtained title company research showing that this tract of land is not pledged as security for any County bond issue and was not conveyed to the County with any reservations as to use by the County or its successors in interest; and,
WHEREAS, the Director of Public Works recommends the conveyance on the terms proposed by the City; and,
WHEREAS, the proposed conveyance is in the best interests of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached conveyance instrument in favor of the City of Blue Springs, Missouri.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
