Body

WHEREAS, the County has created sanitary sewer districts pursuant to §§ 249.430 et seq., RSMo 2000, in the Farview Heights (District 93), Farview North (District 94), Salem East (District 95), and Osage Manor (District 101) subdivisions in the unincorporated area of the County; and,

 

WHEREAS, by Resolution 12785, dated June 28, 1999, the County did enter into a Cooperative Agreement for Sewer Service with the City of Independence, MO, whereby the County contracted with the City for operation of the districts; and,

 

WHEREAS, paragraph III. A. 1 of the Agreement provides for the City to charge the districts' customers a specified rate for the sewer service, subject to adjustment if that rate structure was not adequately recovering costs of the districts' operations, provided that no increase could exceed 5% in any year without the approval of the Legislature and the City's City Council; and,

 

WHEREAS, there was no increase in rates for the year 2000; and,

WHEREAS, the Little Blue Valley Sewer District, which accepts the discharge from the County districts, has advised that its rates will increase for the year 2001; and,

 

WHEREAS, the City's Director of Water Pollution Control has advised that, in view of the Little Blue Valley Sewer District's rate increase, the current rate charges to the customers of the County districts will not adequately recover the costs of operating the districts; and,

 

WHEREAS, the Director of Water Pollution Control has recommended, and the County's Director of Public Works has concurred, that, for customers of the County districts the existing base charge of $12.50/month remain the same, but that the volume charge be increased from its current rate of $1.55 per 100 cubic feet (CCF) to $1.8429/CCF; and,

 

WHEREAS, this rate, if implemented, would lead to an increase in the average monthly sewer bill for customers of the County sewer districts from $23.97 to $26.14, or average of a 9.05% increase; and,

 

WHEREAS, this increase is in the best interests of the health, welfare, and safety of the citizens of the County; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the City of Independence, MO, be and hereby is authorized to increase the monthly volume service charge to customers of Jackson County Sewer Districts 93, 94, 95, and 101, from $1.55/CCF to $1.8429/CCF, in accordance with Exhibit A (Amended) attached hereto.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
